Realization of Collective Rights and Citizenship

This line of research proposes to investigate the basis, justification, and development of collective rights (lato sensu), as well as the existing legal mechanisms for the realization of citizenship (material aspects). Within this context, the aim is to study meta-individual rights related to the consumer, environment, public property and public health, considered diffuse rights par excellence, as well as the interfaces of this generation of human rights with the construction of citizenship based on a welfare state of rights. Regarding the construction of citizenship, special emphasis is given to the study of public policies, corporate social responsibility, third sector, minorities, and neglected populations. The main aim of the systematic study proposed here is the constant assessment of these topics in the contexts of social development, perfectioning of the democratic regime, and improvement of the living conditions of the Brazilian population.

Protection and Custody of Collective Rights

This line of research aims to systematically study existing legal mechanisms to ensure the effective implementation of the material rights studied in the Collective Rights and Citizenship project (procedural aspects). Within this context, procedural mechanisms existing in the national legal system and extra-procedural alternatives for organizing collective disputes and issues related to the construction of citizenship are addressed, in addition to investigations on the procedural microsystem for the custody of pluri-individual interests, including new forms of legal assistance. Special emphasis is also given to alternative mechanisms for solving collective and citizenship-related demands.
